Privacy Policy

Information available to Pinnacle Lists as a result of visiting this Website or the sending of additional e-mail messages or completing surveys and questionnaires, will not be sold, rented or distributed in any way. This Website and communications that result from its use are for the sole express purpose of exchanging information with Pinnacle Lists, who will respond to inquiries regarding products or services and may from time to time send information about these products and services to those who have made inquiries.

Pinnacle Lists (PL) is committed to keeping personal information accurate, confidential, secure and private. Our Corporate Privacy Code builds on this commitment.

This Corporate Privacy Code provides guidelines that PL uses to protect the privacy of personal information, regardless of how the information is collected or stored.

The Corporate Privacy Code consists of ten principles.

PL‘s Privacy Code is based on the Canadian Standards Association (CSA) Model Code for the Protection of Personal Information (CAN/CSA-Q830-96).

As part of our mandate, PL will continue to review its Privacy Code every two years to ensure it is relevant and up-to-date.

1. Accountability

PL has established policies and procedures to comply with the Privacy Code.

PL recognizes that it is responsible for personal information in its possession or custody, including information that has been transferred to a third party for processing.

PL abides by the provisions of the Federal and any Provincial privacy laws, and assumes responsibility for doing so.

2. Identifying Purposes

As an agent involved in the transfer, rental, sale or exchange of direct response lists and other media, PL makes all reasonable efforts to ensure that list and other media owners specify the nature of the intended use of the data at or before the time the information is collected.

3. Consent

PL makes all reasonable efforts to ensure that organizations providing personal information to us or to our clients have obtained consent from the consumer before disclosing this personal information.

PL ensures that all list and other media owners have provided their consumers with a meaningful opportunity to decline to have their name or other information used for any further marketing purposes by a third party.

4. Limiting Collection

As an agent involved in the transfer, rental, sale or exchange of direct response lists and other media, PL makes all reasonable efforts to ensure that list and other media owners limit the collection of the personal information on their lists to that which is necessary for the intended use as identified under Principle 2, Identifying Purposes.

5. Limiting Use, Disclosure, and Retention

As an agent involved in the transfer, rental, sale or exchange of direct response lists and other media PL agrees to keep personal information only as long as necessary for the identified purposes.

6. Accuracy

As an agent involved in the transfer, rental, sale or exchange of direct response lists and other media, PL defers to the obligation of marketers to keep personal information on consumers as up-to-date as possible for the defined need.

7. Safeguards

As an agent involved in the transfer, rental, sale or exchange of direct response lists and other media, PL takes responsibility for the protection of list data. As appropriate, divisions within PL have individually developed.

This includes, but is not limited to, restricting physical access to data, organizational restrictions through security clearances on a “need-to-know” basis, and technological measures such as passwords and encryption. Care is also used in the disposal or destruction of personal information so as to prevent unauthorized parties from gaining access to this information.

8. Openness

Pinnacle Lists is open and forthcoming about the policies and procedures it uses to manage personal information. Consumers have ready access to information about these policies and procedures. Pinnacle Lists makes every effort to ensure that the consumer easily understands personal information handling practices and procedures.

9. Individual Access

Pinnacle Lists will work with consumers, list and other media owners to fulfill the right of the consumer to know of the existence, use and disclosure of his or her.

The consumer must recognize that they are required to provide Pinnacle Lists with sufficient personal information that will allow us to determine whether we do hold a personal information file pertaining to them. The provision of this information shall not be used for any other purpose.

10. Challenging Compliance

Consumers may challenge Pinnacle Lists compliance with its own privacy code. Pinnacle Lists has policies and procedures in place to receive, investigate and respond to consumers’ complaints and inquiries.

Terms of Use

Information products acquired from Pinnacle Lists are leased for single-site use only. Additional location use is subject to an incremental charge.

Customer shall not copy, sell, lease, dispose or otherwise make available to any other person or organization the information products acquired from Pinnacle Lists.

Pinnacle Lists assumes no responsibility for any direct, indirect, special, or consequential damages or loss on the part of the Customer or any third party as a result of the use of the information products. Pinnacle Lists will not be liable for the results of any marketing campaign, or for delays and inconvenience related to the delivery of these products to the customer.

The Customer is responsible for the method of use. Pinnacle Lists does not guarantee the success of any marketing campaign resulting from the use of supplied lists. Opt-In Email campaigns are not guaranteed, either by click through rate or response rate. Pinnacle Lists will not issue any refund or credit for a project based on the performance of the database. Credits, refunds, or replacement of data is limited to the percentage of any list that is greater than the accuracy guarantee of the list provided and only when list owner verification is confirmed. All data records in question must be supplied back to Pinnacle Lists for verification within 30 days of list delivery to be eligible for credit, refund, or replacement. Lost wages, printing or postage costs will not be reimbursed.

Any dollar values quoted by Pinnacle Lists are budgetary only, valid for 30 days from the Date quoted, and are subject to change unless specified otherwise by an authorized Pinnacle Lists representative. Charges may vary according to actual counts and currency exchange rate fluctuations.
